I. TERMS OF SERVICE

Welcome to Atomic Drama.

These Terms of Service (“Terms”) apply to your access to and use of Atomic Drama’s micro-drama story-building and writing-assistance platform, including our websites, web app, Story Builder, Screenplay Studio, Atomic Market, subscription services, exports, communications, and related services (collectively, the “Service”). These Terms form a legally binding agreement between you and Curlewruta LLC d/b/a Atomic Drama (“Atomic Drama,” “Atomic”, “we,” “our,” or “us”).

1. Overview

(a) Using Atomic Drama
Atomic Drama is a micro-drama story-building and writing-assistance platform for writers, creators, producers, studios, and platforms. The Service helps users create micro-drama story outlines, beat sheets, Core Story Bibles, scripts, exports, and marketplace listings using a combination of user input, proprietary genre systems, and AI-assisted features. Atomic Drama uses a proprietary Story Genome, internal taxonomies, matching logic, narrative intelligence, and market-informed genre and audience intelligence to help guide story structure, genre alignment, tropes, audience targeting, narrative pacing, and micro-drama format conventions. The Story Genome is a proprietary internal platform tool. It is not generated from any single user’s activity or inputs and is not owned by any user or project. Atomic Drama uses AI assistance to help infer story elements, generate initial act outlines, build story canon, and support writing workflows. Atomic Drama is not a push-button AI-generation product. It is a writing-assistance platform that requires users to provide creative input, review outputs, edit, rewrite, and make final creative decisions. Your use of the Service is subject to these Terms, our Privacy Policy, Cookie Policy, Acceptable Use Policy, and Intellectual Property Policy, each of which is incorporated into these Terms by reference. If you use Atomic Market, the Atomic Market Participant Agreement also applies. If you use the Service on behalf of a business, studio, platform, or other organization and Atomic Drama processes Personal Data on your behalf, the Data Processing Addendum may also apply.

(b) Business and enterprise use
If you use Atomic Drama on behalf of a company, studio, platform, production company, agency, or other organization, you represent that you have authority to bind that organization to these Terms. In that case, “you” and “your” may refer to both you and that organization. Enterprise, studio, or team accounts may include collaboration, project sharing, administrative controls, workspace permissions, and other business features. Account owners or administrators may be able to access, manage, export, transfer, restrict, or delete content associated with the workspace depending on plan settings and applicable law.

2. Using the Service

(a) Eligibility: You must be at least 18 years old or the age of majority in your jurisdiction to create an account and use Atomic Drama. By creating an account, accessing the Service, or using Atomic Drama, you represent that you meet this requirement and that you can legally agree to these Terms. Atomic Drama may require you to confirm your age or eligibility at signup or through other account controls. If we believe that you do not meet the applicable age requirement, we may restrict, suspend, or terminate your account and delete or limit the associated information, unless retention is required or permitted by law.

(b) Accounts: You must provide accurate account information and keep it up to date. Each person must have their own account. You may not share, sell, transfer, or sublicense account access. You are responsible for keeping your login credentials confidential and for all activity under your account. Atomic Drama may require email/password login or SSO through providers such as Google, Apple, Facebook, or other supported authentication providers.

(c) Access to the Service: Subject to your compliance with these Terms, Atomic Drama grants you a limited, non-exclusive, non-transferable, revocable right to access and use the Service for personal, creative, professional, or internal business purposes. We reserve all rights not expressly granted to you.

(d) Acceptable use: Your use of the Service and your User Content must comply with our Acceptable Use Policy. We may remove content, restrict features, suspend accounts, terminate accounts, or take other action if we believe you have violated our policies, applicable law, third-party rights, or platform integrity.

(e) Service restrictions: You may not, directly or indirectly: Scrape, crawl, harvest, extract, or bulk download the Service or platform data, including the automated scraping or bulk extraction of generative outputs; Reverse engineer, decompile, inspect, or attempt to derive source code, system prompts, model prompts, Story Genome logic, scoring logic, vectors, payloads, or matching logic, or reverse engineer the application interface or API; Use Atomic Drama to build, train, benchmark, or market a competing product; Attempt model extraction, prompt extraction, system extraction, or training-data extraction; Bypass paywalls, rate limits, generation limits, copy controls, security controls, or geographic or pricing restrictions; Share accounts or passwords; Use VPNs, proxies, or similar tools to bypass security, pricing, billing, geographic, or access controls; Upload malware, malicious code, or harmful files; Interfere with the Service or attempt unauthorized access; Use automated systems, bots, scripts, or unauthorized APIs without permission.

3. Security and data privacy

(a) Security: Atomic Drama uses administrative, technical, and organizational safeguards designed to protect the Service and user information. These may include authentication controls, rate limits, infrastructure protections, monitoring, access restrictions, security logging, and vendor security measures. No online service is completely secure, and we cannot ensure that unauthorized access, loss, disclosure, alteration, or destruction will never occur.

(b) Privacy: Our Privacy Policy explains how we collect, use, disclose, store, and protect personal information. Our Cookie Policy explains how we use cookies and similar technologies.

4. User Content and ownership

(a) User Content: “User Content” means story ideas, notes, outlines, beat sheets, locked episodes, project canon, scripts, uploads, exports, marketplace listings, comments, and other material that you create, upload, edit, publish, export, or share through the Service. You retain ownership of your User Content. Atomic Drama does not claim ownership of your User Content or AI-assisted outputs generated for your projects.

(b) Your responsibility for User Content: You represent and warrant that you own or have all rights, licenses, permissions, consents, and clearances necessary for your User Content and your use of it. You may not upload or use copyrighted scripts, books, unpublished works, characters, franchises, formats, pitch decks, treatments, bibles, confidential materials, private documents, third-party IP, images, likenesses, or protected material unless you have all required rights and permissions. You are responsible for legal clearance, copyright, trademark, privacy, publicity, defamation, guild, talent, contract, and production issues related to your content and final work.

(c) License you grant Atomic Drama: To provide the Service, you grant Atomic Drama a limited, worldwide, non-exclusive, royalty-free license to host, store, copy, process, display, transmit, format, modify for technical purposes, analyze, and otherwise use your User Content as necessary to: Operate the Service; Save and display your projects; Generate AI-assisted outputs at your request; Build project canon; Enable editing, locking, re-streaming, exporting, publishing, and collaboration; Provide support; Maintain safety and security; Enforce our policies; Comply with law. If you choose to publish, share, collaborate, export, or opt into Atomic Market, you grant Atomic Drama the additional rights necessary to make that content available according to the settings and features you selected. Atomic Drama will not sell, license, or claim ownership of your private creative work.

(d) Publicity and promotional use: Atomic Drama may use your name, logo, public profile, public Atomic Market listing, testimonials, public screenshots, and public excerpts to promote the Service or promote Atomic Market, where you have made that material public, opted into the relevant feature, provided consent, or where otherwise permitted by law. Atomic Drama will not use private, unpublished project content in marketing without your consent.

5. Atomic Market

Atomic Market is an optional marketplace where users may choose to pitch selected work to producers, studios, platforms, and other marketplace participants. If you opt into Atomic Market, you are responsible for ensuring that your listing and submitted materials are accurate, lawful, non-confidential, non-infringing, and that you have the right to publish, pitch, submit, and commercially exploit the work. Atomic Drama does not guarantee that Atomic Market participation will result in sales, options, commissions, financing, representation, production, distribution, platform acceptance, audience performance, or monetization. Additional marketplace terms, rules, or participant agreements may apply to Atomic Market. If there is a conflict between these Terms and any Atomic Market-specific participant agreement, the Atomic Market-specific agreement will control for marketplace participation.

6. AI-assisted features

(a) Use of AI assistance: Atomic Drama may use AI providers to provide AI-assisted features. These features may infer story elements, generate initial act outlines, support beat-sheet creation, build project canon, assist with rewrites, or support other creative workflows. When you use AI-assisted features, relevant portions of your User Content, story idea, prompts, project canon, selected genre, and related context may be sent through API requests to AI providers so they can return the output you requested.

(b) No AI training on User Content: Atomic Drama does not use User Content to train general AI models. We do not permit our AI providers to use your submitted content to train their general models where provider settings and terms allow us to prevent such training. Atomic Drama may use aggregated, de-identified, or anonymized usage and product analytics to improve the Service.

(c) Human review and substantial editing required: AI-assisted output is a creative starting point, not a finished script, finished episode, legal clearance, production-ready deliverable, or substitute for human creative judgment. You are responsible for reviewing, editing, rewriting, clearing, and approving all AI-assisted output before use, publication, submission, sale, pitch, production, or distribution. Atomic Drama is designed to support human creativity. Users are expected to make substantial human edits and rewrites to AI-assisted output. The human element is what makes a story unique, emotionally specific, and commercially meaningful.

(d) No output guarantees: Atomic Drama does not guarantee that AI-assisted output will be original, accurate, complete, non-infringing, legally cleared, commercially successful, platform-acceptable, audience-validated, production-ready, or suitable for your intended use. Atomic Drama does not guarantee that any output will be free of errors, omissions, similarities to existing works, factual inaccuracies, legal issues, or rights-clearance issues.

7. Story Genome and Atomic Drama intellectual property

The Service, Story Genome, taxonomies, prompt structures, matching systems, vectors, payloads, scoring logic, proprietary narrative intelligence, software, designs, workflows, databases, branding, and related technology are owned by Atomic Drama or its licensors. You may not copy, extract, reproduce, distribute, reverse engineer, or use Atomic Drama’s proprietary systems to build, train, benchmark, market, or improve a competing product or service.

8. Subscriptions, free trials, billing, and cancellation

(a) Free trial: Atomic Drama may offer a 7-day free trial for new users. Unless you cancel before the trial ends, your selected paid subscription will begin automatically and your payment method will be charged through our payment processor. We may limit free trial eligibility, duration, features, or availability at our discretion. We may deny or revoke free trials if we believe a user is abusing the trial system, creating duplicate accounts, bypassing eligibility rules, or violating these Terms.

(b) Subscription plans and renewal: Atomic Drama offers monthly and annual subscription plans. Subscriptions automatically renew at the end of each billing period unless canceled before the renewal date. Monthly plans renew each month. Annual plans renew each year. Your billing period, renewal date, and plan details will be shown at checkout or in your account settings. Atomic Drama does not currently use token credits, usage-based billing, or one-time purchases unless otherwise stated in the Service.

(c) How to cancel: You may cancel your subscription in your account settings or through the billing portal made available in the Service. If you subscribed through a third-party app store, marketplace, or external subscription provider, you may need to cancel through that provider. Cancellation takes effect at the end of your current billing period unless otherwise required by applicable law. You will continue to have access to paid features until the end of the billing period you already paid for.

(d) Access after cancellation: After your paid subscription ends, you may lose access to premium features, including generation, editing, export, collaboration, and marketplace features. Atomic Drama may allow you to access existing project content in view-only mode, subject to account status, technical availability, data-retention rules, and these Terms.

(e) Refunds: Unless required by applicable law or expressly stated by Atomic Drama, subscription fees already paid are non-refundable. This includes partial billing periods, unused time, failure to cancel before renewal, and non-use of the Service. However, Atomic Drama may provide refunds in its discretion, including where required by law, where there has been an accidental duplicate charge, billing error, technical failure that prevents meaningful access, or other exceptional circumstance. To request a refund, contact [email protected] with your account email, billing date, plan, and reason for the request.

(f) EU/UK consumer withdrawal rights: If you are a consumer located in the European Union, European Economic Area, or United Kingdom, you may have a legal right to withdraw from an online subscription contract within 14 days of purchase or renewal, subject to applicable exceptions for digital services and digital content. Where required, Atomic Drama will provide information about your withdrawal rights at checkout. If you request immediate access to digital services or digital content during the withdrawal period, you may be asked to acknowledge that your withdrawal rights may be limited or lost once performance begins, to the extent permitted by applicable law. Nothing in these Terms limits non-waivable consumer rights you may have under applicable law, including any EU/UK withdrawal or cooling-off rights that apply to digital services or digital content.

(g) Price changes: We may change subscription prices or plan features with advance notice where required. Price changes will not apply until the end of your current billing period, your next renewal, or as otherwise required by applicable law. If you do not agree to a price change, you may cancel before the change takes effect.

(h) Account deletion is separate from cancellation: Canceling a subscription does not automatically delete your account or project content. To request account deletion, follow the process described in our Privacy Policy.

(i) Billing, cancellation, and refund questions: Questions about billing, cancellation, or refunds can be sent to: [email protected].

9. Exports and professional responsibility

Atomic Drama may allow exports in supported formats such as text, PDF, Fountain, RTF, FDX, screenplay formats, or other formats. Export availability may vary by plan, feature status, and technical limitations. Atomic Drama is a creative-assistance tool and does not provide legal, business, tax, financing, production, distribution, guild, talent, clearance, or professional advice. You are responsible for copyright, trademark, guild, contract, talent, life-rights, defamation, privacy, publicity-rights, production, financing, and distribution clearance. Atomic Drama does not guarantee commercial success, originality, platform acceptance, audience performance, monetization, financing, sale, option, production, or distribution.

10. Suspension and termination

We may suspend, restrict, or terminate access to Atomic Drama if we believe you have violated these Terms, our Acceptable Use Policy, Intellectual Property Policy, applicable law, third-party rights, payment obligations, security controls, or platform integrity. We may remove or restrict content that violates policy, creates legal risk, threatens safety or security, infringes rights, or exposes Atomic Drama or others to harm. You may stop using Atomic Drama at any time and may cancel your subscription in the app. You may request account deletion by contacting [email protected]

11. Third-party services

Atomic Drama integrates with third-party services, including AI providers, payment processors, hosting providers, security providers, analytics tools, support tools, email providers, advertising platforms, and storage providers. Your use of third-party services may be subject to their own terms and privacy policies. Atomic Drama is not responsible for third-party services outside our control.

12. Feedback

If you provide feedback, ideas, suggestions, enhancement requests, or recommendations about Atomic Drama, you grant Atomic Drama the right to use them without restriction or compensation. Atomic Drama may own improvements, features, products, or services developed from feedback.

13. Warranty disclaimer

The Service is provided “as is” and “as available.” To the maximum extent permitted by law, Atomic Drama disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, reliability, security, uninterrupted operation, and suitability for any creative, legal, commercial, production, or marketplace purpose. Nothing in these Terms excludes, restricts, or modifies any warranty, guarantee, right, or remedy that cannot be excluded, restricted, or modified under applicable consumer law.

14. Limitation of liability

To the maximum extent permitted by law, Atomic Drama and its officers, directors, employees, contractors, affiliates, agents, licensors, and service providers will not be liable for indirect, incidental, consequential, special, exemplary, punitive, or lost-profit damages, or for loss of data, revenue, goodwill, business opportunity, creative opportunity, financing, production, distribution, platform acceptance, or audience performance. To the maximum extent permitted by law, Atomic Drama’s total liability for claims relating to the Service will not exceed the greater of: (a) the amount you paid to Atomic Drama in the 12 months before the claim; or (b) USD $100. Nothing in these Terms limits liability where liability cannot be limited under applicable law, including for fraud, intentional misconduct, or non-waivable consumer rights where applicable.

15. Indemnity

You agree to defend, indemnify, and hold harmless Atomic Drama from claims, damages, liabilities, losses, costs, and expenses, including reasonable attorneys’ fees, arising from or related to: Your User Content; Your use of the Service; Your violation of these Terms or our policies; Your violation of law or third-party rights; Your publication, submission, sale, pitch, production, or exploitation of creative work developed using Atomic Drama; Your marketplace listings or communications. This indemnity applies to the maximum extent permitted by applicable law.

16. Governing law and disputes

These Terms are governed by the laws of the State of Wyoming, USA, without regard to conflict-of-law principles, except where the mandatory laws of your country, state, province, or region require otherwise. Before filing a claim, you agree to contact [email protected] and attempt to resolve the dispute informally. The notice should include your name, account email, a description of the dispute, and the relief you are requesting. You and Atomic Drama agree to attempt to resolve the dispute informally for at least 60 days after the notice is received before either party begins arbitration or court proceedings, except where emergency injunctive relief, intellectual-property enforcement, account-security action, or other urgent relief is reasonably necessary. Except where prohibited by applicable law, disputes will be resolved through binding individual arbitration. No class actions, class arbitrations, representative actions, private attorney general actions, or consolidated actions are permitted unless applicable law requires otherwise. If you are a consumer located in the European Union, European Economic Area, United Kingdom, Switzerland, Canada, or another jurisdiction where mandatory consumer-protection laws give you rights that cannot be waived by contract, nothing in these Terms limits those non-waivable rights. You may have the right to bring claims in your local courts or to use local consumer dispute-resolution procedures where applicable law requires. For disputes that may be brought in court, the parties consent to the state and federal courts located in Wyoming, USA, unless applicable law requires a different venue.

17. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will provide notice by email, in-app notice, website notice, or other reasonable means. Continued use of Atomic Drama after changes become effective means you accept the updated Terms.

II. PRIVACY POLICY

What does this policy cover?
Welcome to Atomic Drama.

This Privacy Policy explains how Atomic Drama, a service operated by Curlewruta LLC (“Atomic Drama,” “Atomic,” “we,” “our,” or “us”), collects, uses, discloses, stores, transfers, and protects information when you use Atomic Drama’s websites, web app, Story Builder, Screenplay Studio, Atomic Market, subscription services, communications, and related services (collectively, the “Service”).

Atomic Drama is a micro-drama story-building and writing-assistance platform for writers, creators, producers, studios, and platforms. The Service helps users create micro-drama story outlines, beat sheets, Core Story Bibles, scripts, exports, and marketplace listings using a combination of user input, proprietary genre systems, and AI-assisted features.

If you do not want your information processed as described in this Privacy Policy, you should not use the Service.

1. Information we collect

We collect the following types of information about you.

(a) User-provided information, also known as information you give us
We collect information you choose to give us, such as your name, email, profile details, support messages, and account information, when you create an account, subscribe to the Service, use the Service, contact us, complete onboarding, update your profile, request support, join Atomic Market, or otherwise interact with us. We use this information to create and manage your account, provide the Service, communicate with you, support your use of Atomic Drama, maintain security, and operate our subscription and billing systems. This information may include:

  • First and last name, email address, and username
  • Password credentials or authentication-provider ID
  • Company, studio, or agency name and associated email address
  • Role, profession, and interests
  • Country or location information you provide
  • Age and gender
  • Marketing preferences
  • Support messages
  • Feedback, survey responses, and communications with us

(b) Information we receive from third-party login or authentication services
If you sign in using a third-party authentication service, such as Google, Apple, Facebook, WeChat, or another SSO provider, we may receive information that provider makes available to us. This may include your name, email address, account identifier, profile image, authentication token, or other information you authorized the provider to share. If you disconnect a third-party login, we may stop receiving new information from that provider, but we may retain information already received where permitted by law and as needed to provide the Service.

(c) Information we receive from payment providers
Atomic Drama uses third-party payment providers to process payments and subscriptions. We do not see or store your full credit-card number or payment-card details. These payment providers may share payment-related information with us, such as customer ID, subscription status, plan, renewal date, billing history, invoice status, cancellation status, and payment-failure notices. We use this information to manage subscriptions, free trials, renewals, cancellations, invoices, fraud prevention, customer support, and billing communications.

(d) Information we receive from other third parties
We may receive information about you from third parties such as analytics providers, advertising platforms, referral partners, social media platforms, security vendors, support tools, and business data providers. This information may include referral source, ad engagement, campaign attribution, business profile information, location information, device information, and information about how you interacted with our ads or website. We may use this information to understand how users discover Atomic Drama, measure advertising performance, prevent fraud and abuse, personalize communications where permitted, and improve the Service.

(e) Technical and usage information we collect automatically
When you use the Service, we automatically collect or generate certain information, including:

  • Usage logs, Product analytics events, Clickstream data, Feature interactions
  • Pages viewed, Session data, Browser type, Device type, Operating system
  • Referring and exit pages, Approximate location information
  • IP address, which may be hashed, truncated, or otherwise protected where appropriate
  • Authentication and security events, Rate-limit signals, Error logs and crash reports

We use this information to operate, secure, debug, improve, and analyze the Service.

(f) Cookies and similar technologies
We and our partners use cookies, pixels, tags, SDKs, local storage, device identifiers, and similar technologies to recognize your browser or device, keep you signed in, secure your account, remember your preferences, understand how the Service is used, measure performance, detect errors, attribute advertising, and serve or measure ads. For more information about how we use these technologies and how you can manage them, please read our Cookie Policy.

(g) Log file information
Our servers and service providers automatically record certain log file information when you use Atomic Drama. This may include web requests, browser type, device information, referring and exit URLs, pages viewed, timestamps, security events, authentication events, and information about how you interact with links or features.

(h) Clear GIFs, pixels, and email tracking
We may use web beacons, pixels, tags, clear GIFs, and similar technologies in our website, app, ads, and emails. These technologies may help us understand whether users open emails, click links, visit pages, complete signups, start trials, subscribe, or return after seeing an ad.

(i) Device identifiers
When you access Atomic Drama on a device, we or our service providers may collect or generate device identifiers, advertising identifiers, browser identifiers, session identifiers, or similar information. These identifiers help with authentication, security, fraud prevention, analytics, preferences, and advertising attribution.

(j) Location data
We may collect or infer approximate location information from your IP address, account information, payment provider, device settings, or information you provide directly. We use location information to comply with local laws, calculate taxes, support billing, detect fraud or suspicious activity, localize the Service, improve analytics, and measure advertising performance.

(k) Content within your account
We collect and store content you create, upload, edit, generate, publish, export, or share through Atomic Drama. This content is collected so we can provide the Service, save your projects, generate requested outputs, support edits and rebuilds, build project canon, enable exports, operate the Screenplay Studio, and support Atomic Market if you opt in. This includes story ideas, genre selections, story outlines, act summaries, beat sheets, locked episodes, project canon, scripts, uploaded files, exported files, marketplace listings, collaboration comments, and project metadata, where applicable.

(l) AI-processing information
When you use AI-assisted features, relevant portions of your story idea, project content, genre selection, project canon, prompts, and related context may be sent through API requests to AI providers so they can return the AI-assisted output you requested. Atomic Drama does not use User Content to train general AI models. AI providers may still process relevant project context through API calls to provide the AI-assisted features you request. We do not permit our AI providers to use your submitted content to train their general models where provider settings and terms allow us to prevent such training. Where available, we configure provider settings and agreements to limit provider use, storage, and retention of submitted content.

2. How we use your information

(a) Providing the Service: We use information to create accounts, authenticate users, operate the Story Builder, match story ideas to relevant genre systems, generate act-by-act story outlines, save projects, support locked episodes and canon generation, operate the Screenplay Studio, provide exports, enable collaboration where available, and operate Atomic Market.

(b) The Story Genome: Atomic Drama uses a proprietary Story Genome, internal taxonomies, matching systems, and related tools to help guide story structure, genre alignment, tropes, audience targeting, narrative pacing, and micro-drama format conventions. The Story Genome is a proprietary internal platform tool. It is not generated from any single user’s activity or inputs and is not owned by any user or project.

(c) Providing AI-assisted features: We use relevant project information to generate AI-assisted outlines, beat sheets, act summaries, story-development suggestions, and related outputs that you request. AI-assisted outputs are starting points only and must be reviewed, edited, rewritten, cleared, and approved by you before use.

(d) Customizing and improving the Service: We may use information about your account, preferences, activity, and use of the Service to personalize the experience, improve recommendations, suggest relevant workflows, detect where users get stuck, improve onboarding, improve product design, and develop new features.

(e) Data analytics and product performance: We use analytics to understand how Atomic Drama is used, including signup flows, feature usage, story-builder interactions, screenplay-editor behavior, errors, conversion funnels, subscription activity, and user retention. We may use tools such as PostHog, Google Analytics, Sentry, LogRocket, Hotjar, Microsoft Clarity, or similar tools.

(f) Safety, security, fraud, and abuse prevention: We use information to detect, investigate, prevent, and respond to security risks, fraud, abuse, unauthorized access, account sharing, scraping, reverse engineering, policy violations, payment abuse, spam, scams, phishing, content misuse, and violations of our Terms of Service or Acceptable Use Policy.

(g) Content moderation and policy enforcement: Atomic Drama may review User Content using automated tools and manual review for safety, abuse prevention, support, quality control, policy enforcement, legal compliance, and platform integrity. This may include reviewing content that is reported, published, shared, submitted to Atomic Market, associated with suspicious activity, or involved in a support request.

If you publish content, share a project, invite collaborators, export files, or opt into Atomic Market, the information you choose to share may be visible to other users, collaborators, producers, studios, platforms, marketplace participants, search engines, or the public depending on the feature and your settings. You are responsible for ensuring that anything you share or publish does not include confidential, unlawful, infringing, private, or unauthorized third-party material.

(c) Enterprise accounts and collaboration: If you use Atomic Drama through an enterprise, studio, platform, team, or organization account, the account owner or administrator may be able to access, manage, export, transfer, restrict, or delete content associated with that workspace depending on the plan and settings.

(d) Atomic Market: If you opt into Atomic Market, selected project information and marketplace materials may be made available to marketplace users, producers, studios, platforms, and other participants. We may use marketplace listings, public-facing profile information, and public marketplace materials to operate, promote, and improve Atomic Market. Atomic Drama does not guarantee that marketplace participation will result in sales, options, commissions, financing, production, distribution, or platform acceptance.

(e) Sharing for advertising: We may share certain information with advertising and analytics partners for ad attribution, retargeting, audience creation, and conversion measurement. These partners may include Meta, TikTok, Google, YouTube, and similar platforms. You may not use Atomic Drama to create scripts, stories, pitches, or marketplace listings using living real people, private individuals, celebrities, creators, executives, writers, actors, influencers, or other identifiable persons without all required rights, permissions, and legal clearances.

4. Fraud, deception, and impersonation

You may not use Atomic Drama to impersonate others, misrepresent identity, fabricate endorsements, create scams, produce phishing content, create deceptive marketplace listings, mislead producers or platforms, or falsely claim rights, attachments, authorship, financing, representation, option status, production status, or market interest.

5. Atomic Market conduct

When using Atomic Market, you may not:

  • Misrepresent ownership, rights, authorship, credits, attachments, financing, production status, or market interest
  • Upload confidential third-party material
  • Pitch content you do not have the right to pitch
  • Harass, spam, mislead, or deceive marketplace participants
  • Use the marketplace to solicit unlawful transactions

  • Scrape, crawl, extract, harvest, or bulk download content, prompts, outputs, payloads, metadata, or platform data
  • Reverse engineer, decompile, inspect, or attempt to derive source code, system prompts, model prompts, Story Genome logic, scoring logic, or matching logic
  • Use automated systems, bots, scripts, or unauthorized API access
  • Attempt model extraction, prompt extraction, benchmark extraction, or training-data extraction
  • Share, sell, transfer, or sublicense account access
  • Use VPNs, proxies, or similar tools to bypass security, geographic, pricing, billing, or access controls
  • Circumvent paywalls, rate limits, usage limits, generation limits, copy controls, or security measures

  • Interfere with service availability or security

Atomic Drama may investigate violations using automated tools, manual review, vendor reports, user reports, payment signals, analytics, security logs, and support information. We may remove or restrict content in response to valid trademark or brand complaints.

5. Publicity, likeness, and living-person complaints

Atomic Drama prohibits users from creating scripts, projects, marketplace listings, exports, or promotional materials using the name, image, likeness, biography, identity, voice, persona, private information, or publicity rights of any living real person without required consent, rights, permissions, and legal clearances. If you believe your name, image, likeness, biography, identity, voice, persona, private information, or publicity rights are being misused on Atomic Drama, contact [email protected] with enough detail for us to review the issue.

Your publicity, likeness, or living-person complaint should include:

  • Your name, mailing address, telephone number, and email address
  • A description of the name, image, likeness, biography, identity, voice, persona, private information, or publicity right at issue
  • A description and location of the material you believe misuses those rights
  • An explanation of why you believe the use is unauthorized or unlawful
  • Any supporting documentation that helps us verify your identity or authority to act
  • A statement that the information in your notice is accurate
  • Your physical or electronic signature

We may remove or restrict content in response to valid publicity, likeness, privacy, or living-person complaints.

6. Other intellectual-property or rights complaints

If you believe that content on Atomic Drama violates another intellectual-property right, contractual right, confidentiality obligation, privacy right, or other legal right, contact [email protected] with enough detail for us to review the issue.

Your complaint should include:

  • Your name, mailing address, telephone number, and email address
  • A description of the right you believe has been violated
  • A description and location of the material at issue
  • An explanation of why you believe the material violates your rights
  • Any supporting documentation
  • A statement that the information in your notice is accurate
  • Your physical or electronic signature

We may remove or restrict content where appropriate.

7. DMCA counter-notices for copyright removals

If your content was removed or restricted because of a copyright complaint and you believe the removal was mistaken or the content was misidentified, you may send a DMCA counter-notice to our designated Copyright Agent at [email protected].

Your counter-notice should include:

  • Your name, mailing address, telephone number, and email address
  • Identification of the material that was removed or restricted and where it appeared before removal
  • A statement, under penalty of perjury, that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification
  • A statement that you consent to the jurisdiction of the appropriate court for your address, or if outside the United States, to an appropriate court in the United States
  • A statement that you will accept service of process from the person who submitted the original copyright complaint or that person’s agent
  • Your physical or electronic signature

We may restore content where appropriate and legally permitted. This DMCA counter-notice process applies to copyright removals. Trademark, publicity, likeness, privacy, confidentiality, and other non-copyright complaints may be handled through a separate review process and may not be eligible for the same DMCA counter-notice procedure.

8. Repeat infringers

Atomic Drama may suspend or terminate accounts of users who repeatedly infringe or are repeatedly accused of infringing intellectual-property rights, where appropriate and legally required. We may also restrict, remove, or disable access to content or accounts that create legal risk, violate this Policy, violate our Terms, or violate our Acceptable Use Policy.

9. No legal advice or rights clearance

Atomic Drama does not provide legal advice, rights clearance, title clearance, copyright clearance, trademark clearance, life-rights clearance, publicity-rights clearance, privacy clearance, guild clearance, talent clearance, or production clearance. Users are responsible for clearing all rights before publishing, pitching, selling, submitting, producing, distributing, exporting, or commercially exploiting work. Atomic Drama may provide tools that help users create, organize, export, pitch, or develop creative material, but those tools do not replace legal review, rights clearance, professional advice, or user responsibility.

VI. DATA PROCESSING ADDENDUM

This Data Processing Addendum (“DPA”) forms part of the agreement between the customer or organization that has agreed to this DPA (“Customer”) and Curlewruta LLC d/b/a Atomic Drama (“Atomic Drama”) where Atomic Drama processes Personal Data on behalf of Customer in connection with Customer’s use of the Service. This DPA applies only where Atomic Drama acts as a processor or service provider on behalf of Customer under applicable Data Protection Laws. Where Atomic Drama determines the purposes and means of processing, Atomic Drama acts as an independent controller as described in the Privacy Policy.

1. Definitions

“Data Protection Laws” means applicable privacy, data protection, and data security laws, including the GDPR, UK GDPR, Data Protection Act 2018, applicable U.S. state privacy laws, and any other law that applies to the processing of Personal Data under this DPA.
“Personal Data” means information relating to an identified or identifiable person that is processed by Atomic Drama on behalf of Customer.
“Customer Data” means User Content, account data, project data, files, scripts, outlines, marketplace materials, workspace data, and other data submitted to the Service by or on behalf of Customer.
“Sub-processor” means a third party engaged by Atomic Drama to process Personal Data on behalf of Customer.

2. Roles of the parties

For Customer Data that Atomic Drama processes on behalf of Customer, Customer is the controller and Atomic Drama is the processor. For certain account, billing, security, analytics, and service-administration data, Atomic Drama may act as an independent controller as described in the Privacy Policy.

3. Processing instructions

Atomic Drama will process Personal Data only on Customer’s documented instructions, including as necessary to provide the Service, comply with the Agreement, comply with this DPA, and comply with applicable law. Customer instructs Atomic Drama to process Personal Data to: Provide the Service; Host and store Customer Data; Authenticate users; Support project collaboration; Provide AI-assisted features requested by Customer or its users; Provide support; Maintain security and abuse prevention; Process billing and subscription administration; Comply with legal obligations.

4. Details of processing

The details of the processing operations, including the subject matter, duration, nature, and purpose of the processing, as well as the categories of Personal Data and data subjects, are set forth in Schedule 1 (Details of Processing) attached to this DPA.

5. Confidentiality

Atomic Drama will ensure that personnel authorized to process Personal Data are bound by confidentiality obligations or are subject to appropriate statutory confidentiality obligations.

6. Security measures

Atomic Drama will implement appropriate technical and organizational measures designed to protect Personal Data against unauthorized or unlawful processing and accidental loss, destruction, damage, alteration, or disclosure. These measures may include access controls, encryption where appropriate, logging, authentication controls, rate limits, vendor controls, monitoring, and infrastructure protections.

7. Sub-processors

Customer authorizes Atomic Drama to use Sub-processors to engage Sub-processors to provide, secure, support, maintain, improve, and administer the Service. Atomic Drama will maintain a list of current Sub-processors in Schedule 2 to this DPA or in another location made available to Customer. Atomic Drama will require Sub-processors to protect Personal Data under contractual obligations no less protective than those required by applicable law. Where required by applicable law or contract, Atomic Drama will provide notice of any material addition or replacement of Sub-processors and allow Customer to object on reasonable data-protection grounds within the notice period stated in the applicable agreement or notice. If Customer objects, the parties will work in good faith to resolve the objection. If the objection cannot reasonably be resolved, Customer may stop using the affected portion of the Service or terminate the applicable order or agreement to the extent required by applicable law or contract. Atomic Drama remains responsible for its Sub-processors’ performance of their data-protection obligations to the extent required by applicable Data Protection Laws.

8. Data subject requests

Atomic Drama will provide reasonable assistance to Customer, taking into account the nature of processing, to help Customer respond to data subject access, correction, deletion, portability, objection, restriction, or withdrawal requests. If Atomic Drama receives a request directly relating to Personal Data processed on behalf of Customer, Atomic Drama may redirect the requester to Customer unless legally required to respond.

9. Security incidents

Atomic Drama will notify Customer without undue delay after becoming aware of a personal-data breach affecting Personal Data processed on behalf of Customer. The notice will include available information reasonably necessary for Customer to meet its breach-notification obligations.

10. International transfers

Atomic Drama and its Sub-processors may process Personal Data in the United States and other countries. Where required, Atomic Drama will use appropriate transfer safeguards, such as standard contractual clauses, the UK International Data Transfer Addendum, adequacy decisions, or other lawful transfer mechanisms.

11. Return or deletion

Upon termination of the Agreement, Atomic Drama will delete or return Personal Data according to Customer’s instructions, the Service settings, and Atomic Drama’s retention policies, unless continued retention is required or permitted by law, security, backup, dispute, fraud-prevention, or compliance needs.

12. Audits and information

Atomic Drama will make available information reasonably necessary to demonstrate compliance with this DPA. Audits may be satisfied through security documentation, certifications, questionnaires, summaries, or other reasonable methods unless applicable law requires otherwise.

13. Liability

The parties’ liability under this DPA is subject to the limitations of liability in the Agreement unless prohibited by applicable law.


Schedule 1: Details of Processing

This Schedule 1 describes the processing of Personal Data by Atomic Drama on behalf of Customer under the Data Processing Addendum.

1. Subject matter of processing

Atomic Drama processes Personal Data to provide, secure, support, maintain, administer, and improve Atomic Drama’s micro-drama story-building, writing-assistance, collaboration, marketplace, account-management, subscription, and related services for Customer.

2. Duration of processing

Atomic Drama will process Personal Data for the term of the applicable customer agreement, subscription, order, or account relationship, and for any additional period required or permitted by the agreement, the Service settings, backup systems, security needs, fraud-prevention needs, dispute-resolution needs, legal obligations, tax/accounting requirements, or applicable law.

3. Nature of processing

The processing may include collection, recording, organization, structuring, hosting, storage, retrieval, access, transmission, display, use, analysis, generation, modification, formatting, export, deletion, security monitoring, troubleshooting, support, authentication, logging, and AI-assisted processing where enabled or requested by Customer or its authorized users.

4. Purpose of processing

The purpose of processing is to provide the Service to Customer and its authorized users, including to:

  • Provide and operate the Story Builder, Screenplay Studio, Crazy Market / Atomic Market, collaboration tools, exports, account tools, and related features
  • Create, authenticate, manage, and support user accounts
  • Host, store, retrieve, display, edit, export, and manage Customer Data
  • Provide AI-assisted story-building, outlining, beat-sheet, canon-generation, rewrite, and creative-assistance features requested by Customer or its users
  • Provide customer support and troubleshooting
  • Maintain security, fraud prevention, abuse prevention, logging, rate limiting, and platform integrity
  • Process subscriptions, billing administration, invoices, payment status, and account administration
  • Analyze technical performance, errors, reliability, and product usage where permitted by the agreement and applicable law
  • Comply with legal obligations and enforce applicable agreements and policies

5. Categories of data subjects

The Personal Data processed may relate to the following categories of data subjects:

  • Customer’s employees, contractors, representatives, administrators, and authorized users
  • Customer’s collaborators, invited users, writers, creators, producers, studio users, platform users, reviewers, or marketplace participants
  • Individuals who contact Atomic Drama for support on behalf of Customer
  • Individuals whose Personal Data is included in Customer Data, User Content, scripts, project materials, uploaded files, marketplace listings, communications, or support materials submitted by Customer or its authorized users
  • Other individuals whose Personal Data is submitted to the Service by or on behalf of Customer

6. Categories of Personal Data

The Personal Data processed may include:

  • Account data, such as name, email address, username, account ID, authentication identifiers, profile details, organization name, role, workspace membership, and account settings
  • Contact data, such as email address, support contact details, business contact information, and communication metadata
  • Authentication and security data, such as login events, SSO identifiers, authentication-provider IDs, access tokens where applicable, IP address, device/browser data, session data, rate-limit signals, and security logs
  • Customer Data and User Content, such as story ideas, outlines, beat sheets, act summaries, scripts, project canon, uploaded files, exported files, marketplace listings, collaboration comments, project metadata, prompts, AI-assisted outputs, and related creative materials
  • Usage and technical data, such as feature interactions, product analytics events, logs, error reports, crash reports, device/browser information, pages viewed, and Service activity
  • Support data, such as support messages, screenshots, files or materials submitted for troubleshooting, chat history, and related communications
  • Billing and subscription administration data, such as customer ID, plan, subscription status, renewal date, invoice metadata, cancellation status, payment-failure notices, and payment-provider metadata, but not full payment-card numbers stored by Atomic Drama
  • Marketplace-related data, where applicable, such as profile information, project listing information, pitch materials, submission metadata, participant communications, and marketplace activity

7. Sensitive Personal Data

Atomic Drama does not require Customer to submit sensitive Personal Data to use the Service.

Customer is responsible for avoiding unnecessary submission of sensitive Personal Data, including government identifiers, financial account numbers, health information, precise location data, biometric data, children’s data, criminal-offense data, union membership, political opinions, religious beliefs, sexual orientation, or other sensitive categories unless Customer has a lawful basis and all required rights, notices, consents, and authorizations.

To the extent Customer submits sensitive Personal Data in Customer Data, Atomic Drama will process that data only as necessary to provide the Service, comply with Customer’s documented instructions, comply with the DPA, and comply with applicable law.

8. Special categories of creative or third-party content

Because the Service is used for story-building, scripts, marketplace listings, and creative development, Customer Data may include names, likeness references, biographical references, fictionalized materials, character descriptions, project notes, or other materials submitted by Customer or its users.

Customer is responsible for ensuring that Customer Data does not include unlawful, infringing, confidential, private, or unauthorized third-party material and that Customer has all rights, permissions, notices, and legal bases required to submit and process that material through the Service.

9. Controller obligations and rights

Customer determines the purposes and means of processing Customer Personal Data and is responsible for:

  • Providing all required notices to data subjects
  • Obtaining all required consents or other lawful bases
  • Ensuring Customer Data may lawfully be submitted to and processed through the Service
  • Responding to data subject requests where Customer is the controller
  • Ensuring authorized users comply with the agreement, DPA, and applicable law
  • Providing documented processing instructions to Atomic Drama
  • Using the Service in accordance with applicable privacy, data-protection, intellectual-property, confidentiality, employment, and consumer-protection laws

Customer has the rights described in the DPA, including rights relating to documented instructions, data subject request assistance, security incident notification, return or deletion, sub-processor information, and information reasonably necessary to demonstrate compliance.

10. Processor obligations

Atomic Drama will process Personal Data only as described in the DPA, the applicable agreement, Customer’s documented instructions, and applicable law. Atomic Drama will implement appropriate technical and organizational measures, maintain confidentiality obligations for authorized personnel, assist Customer as described in the DPA, and use Sub-processors only as permitted by the DPA.

Changes to sub-processors: Atomic Drama may update this list from time to time. VII. ATOMIC MARKET PARTICIPANT AGREEMENT

This Atomic Market Participant Agreement (“Agreement”) governs your use of Atomic Market, an optional marketplace feature within Atomic Drama that allows creators to publish, pitch, discover, review, and communicate about micro-drama projects. Atomic Market is operated by Curlewruta d/b/a Atomic Drama (“Atomic Drama,” “we,” “our,” or “us”). This Agreement applies in addition to Atomic Drama’s Terms of Service, Privacy Policy, Acceptable Use Policy, Intellectual Property Policy, and Cookie Policy.

1. Eligibility

You may use Atomic Market only if you meet Atomic Drama’s account eligibility requirements and comply with all applicable marketplace rules. Atomic Drama may require additional verification for creators, producers, studios, platforms, buyers, representatives, or enterprise participants.

2. Creator submissions

If you publish or submit a project to Atomic Market, you represent and warrant that:

  • You own or control all rights necessary to submit, pitch, publish, display, and commercially exploit the project
  • The submission does not include confidential third-party material
  • The submission does not infringe intellectual-property, privacy, publicity, contractual, guild, talent, or other rights
  • The submission does not use living real people without required consent and clearance
  • The submission is accurate and not misleading
  • You have disclosed any material rights restrictions, co-owners, encumbrances, prior options, attachments, or commitments

3. Marketplace visibility

If you opt into Atomic Market, selected project information may be visible to marketplace participants, including producers, studios, platforms, buyers, representatives, and other users, depending on your settings. Atomic Drama may use public marketplace listings, public profile information, and public excerpts to operate, promote, and improve Atomic Market. Atomic Drama will not sell or license your private creative work without your permission.

4. No agency or representation

Atomic Drama is not your agent, manager, lawyer, producer, financier, distributor, guild representative, or talent representative. Atomic Drama does not guarantee that your project will be reviewed, purchased, optioned, financed, produced, distributed, or accepted by any platform.

5. Producer, studio, and platform conduct

If you use Atomic Market as a producer, studio, platform, buyer, representative, or industry participant, you agree not to:

  • Misrepresent your identity, authority, company, credits, financing, or intentions
  • Misuse creator submissions or confidential materials
  • Circumvent Atomic Drama’s marketplace rules
  • Harass, spam, pressure, deceive, or exploit creators
  • Claim ownership of creator submissions unless rights are separately acquired in a written agreement
  • Use marketplace access to scrape, extract, train models, or build a competing marketplace or dataset

6. No transaction guarantee

Atomic Drama may facilitate discovery, communication, and marketplace visibility, but Atomic Drama is not responsible for negotiations, contracts, options, purchases, financing, production, distribution, payments, credits, guild compliance, or disputes between marketplace participants unless expressly agreed in writing.

7. Confidentiality caution

Atomic Market is not a substitute for an NDA or legal representation. Do not publish or submit confidential material unless you are comfortable sharing it with the intended audience and have appropriate protections in place.

8. Takedowns and disputes

Atomic Drama may remove or restrict marketplace listings that violate this Agreement, the Terms, the AUP, the IP Policy, law, or third-party rights. Rights complaints should be submitted under the Intellectual Property Policy. Atomic Drama may, but is not required to, mediate marketplace disputes.

9. Fees and paid marketplace features

Atomic Drama may charge fees for marketplace access, premium listings, submissions, subscriptions, promotion, transactions, or other paid marketplace features. Any such fees will be disclosed before purchase.

10. Termination of marketplace access

Atomic Drama may suspend or terminate Atomic Market access if we believe a participant has violated this Agreement, misused submissions, infringed rights, misrepresented information, created legal risk, or harmed marketplace integrity.
